shipping services, you agree to be bound by the terms of this Shipping Service Agreement. If you do not
agree to these terms, do not use our shipping services.
1. Service Description
The Elite Creative Solutions provides air shipping services from Nigeria to the UK and other international
destinations. Our services include:

Air Shipping Nigeria to UK: Doorstep delivery in 7-10 working days. Minimum shipment
of 10kg.

Freight & Cargo Services (Nigeria to The World): Door-to-door delivery in 10-15
working days.

Minimum accepted shipments: 10kg for UK & other European countries, 15kg for US &
Canada, and 20kg for Australia.

Weight-based pricing: See detailed pricing tables below.

Multiple destinations: Ireland, USA, Canada, Australia, France, Netherlands, Italy, Germany, Austria, Belgium, Switzerland, Sweden, Poland, Finland, Norway, Malta, and more.

Inbound Shipping to Nigeria: Services for receiving items from outside the country to
Nigeria (see pricing table for details).
2. Pricing and Payment Terms
Our pricing structure is weight-based and destination-specific.

2.5. Additional charges

Repackaging services: ₦2,000 per carton.

Pallet Fee:
- 1kg extra for pallet for parcels below 40kg.
- Below 70kg: 2kg.
- Below 100kg: 3kg.
- Below 130kg: 4kg.
- Below 160kg: 5kg.
- Below 200kg: 6kg.
- Below 220kg: 6kg.
- Below 250kg: 7kg.
- Above 250kg: FULL PALLET WEIGHT.

Premium Goods:
- General Premium goods (proteins) attract extra payment of ₦2,000 per kilo for shipment outside the UK.
- Box creation for Palm Oil and Liquid below 5kg: ₦3,000. Above 5kg is subject to further charges.

Home or Bus Stop Pick-up: Attracts extra charges.

Ibadan Office Drop-off: ₦2,000 per kilo extra.

Customs Duty (Europe-bound): £15 per parcel.

Customs Duties and VAT: Customer responsibility, paid in countries where applicable.

Redelivery Fee: Customer is responsible for payment of the redelivery fee (£1 per KG)
if a parcel is returned due to customer error (e.g., wrong address, refusal to receive, damaged parcel due
to contents).
3. Shipping Restrictions and Prohibited Items
The following items are prohibited or restricted:

Prohibited Items in Nigeria: In Nigeria, we are only bound not to ship items on the prohibited list of airlines and general contraband items such as cocaine, Indian hemp, marijuana, cigarettes, batteries, and alcoholic contents. All other items are shipped at the owner's risk as far as the customs of the destination country is concerned. You are responsible for ensuring the contents you are shipping are allowed into your destination country. We shall not be liable for any goods seized by customs in destination countries.

International Shipping Regulations: All items must comply with international shipping regulations of both Nigeria and the destination country.

Food and Perishable Items Handling Policy: All food items and other perishables are carried at the
owner's risk. We recommend proper packaging suitable for international transit for such items.
Important Notice: All our customers are put on notice that all parcels going outside the UK are routed through our UK office. Therefore, UK rules apply to all parcels, especially on customs-related matters. Ensure your shipments comply with UK customs regulations in addition to your destination country's requirements.
4. Delivery Terms and Timeframes
We provide the following delivery commitments:

Nigeria to UK: 7-10 business days doorstep delivery.

Other International Destinations: 10-15 business days door-to-door.

Business Day Calculation: All estimated delivery timelines are calculated in business days only. Weekends (Saturday and Sunday) and officially recognised public holidays in both the origin country (Nigeria) and the destination country shall not be counted when determining or calculating the estimated delivery date. Delivery timeframes start counting from the next business day after parcel drop-off at our office.
- We do not collect or deliver parcels on Saturday and Sunday.
- Collection or drop-off service in our Nigeria and UK offices is only available from Monday to Friday, 9am to 5pm.
- Public holidays observed in Nigeria or the destination country will extend the estimated delivery date by the equivalent number of holiday days.
Important: All quoted delivery timeframes are in business days only and exclude weekends and public holidays in both the origin and destination countries. Delivery timeframes further exclude customs clearance delays and are subject to weather conditions and carrier availability.
Please do not call or text our customer service numbers for an update on delivery if the stated deadline has
not expired.
5. Loss and Damage Policy
CRITICAL REQUIREMENT: The first condition for receiving compensation for LOST OR DAMAGED
goods is to attach a purchase invoice to your parcels when submitting them to our office for shipment.
Compensation Claims:
• Purchase invoice/receipt MUST be attached for any compensation claims.
• We will NOT pay any form of compensation based on verbal claims.
• The maximum payable amount for a damage/lost claim is ₦100,000 (one hundred thousand Naira) + freight cost.
• Failure to attach purchase receipts means you accept that if anything happens to your parcel (loss or
damage), you are not entitled to any form of compensation.
Example: If your goods are worth ₦5 million, you must still attach a verifiable invoice to them at the point
of submission to us. However, please note that the maximum compensation payable by us is ₦100,000 (one hundred thousand Naira) + freight cost. While we
try our best to ensure safe handling of goods, failure to provide proper documentation means you accept full
responsibility for any loss or damage.
Invoice Exemption: Parcels whose declared value is
below ₦70,000 are duty & VAT free and do not require the
presentation of a purchase invoice.
6. Customer Responsibilities
As a customer of The Elite Creative Solutions, you agree to:
- Provide accurate recipient information including full name, address, email, and phone number.
- Submit parcels with a valid means of identification.

Attach purchase invoices for all shipments, especially for potential compensation claims. Exception: Parcels with a declared value below ₦70,000 are duty & VAT free and do not require a purchase invoice.

Provide a statement of origin certificate when required by customs authorities. It is your responsibility to ensure all required documentation is available for customs clearance.

Pay all applicable duties, taxes, and VAT to the destination country's customs, where applicable. For
UK destinations, a payment of 20% VAT is applicable for any declared parcel whose receipt shows it's worth £39 or more, approximately
₦70,000 or more. All UK-bound parcels valued below ₦70,000 are duty and VAT free and do not require presentation of invoice/purchase receipt. However, payment for shipment without presentation of receipt/invoice means your parcel is valued below ₦70,000 and it will be treated as such.
- Ensure proper packaging to prevent damage during transit.

Report any delivery issues within a reasonable timeframe (e.g., within 48 hours of expected delivery
date).
- Understand and agree to any updates or changes to these terms once you are informed.
7. Customs and Regulatory Compliance
Customers are responsible for ensuring their shipments comply with all applicable laws and regulations of
both Nigeria and the destination country:
- Customs duties and VAT are the customer's responsibility and are paid in countries where applicable.
- Proper declaration of goods value and contents is mandatory.

Statement of origin certificates must be provided when required by customs authorities.
- Restricted items may be subject to additional screening and may incur delays or confiscation.
- False declarations may result in service termination and legal consequences.

We shall not be held liable for any goods seized by customs due to the nature of the items or incorrect
declaration.

We shall not be liable for any parcels or consignment that get lost or damaged in transit due to the
failure or refusal of the consignee to pay their CUSTOMS DUTY & VAT on time when required.

All parcels going outside the UK are routed through our UK office. Therefore, UK customs rules and regulations apply to all international parcels, especially on customs-related matters. Customers must ensure their shipments comply with UK customs requirements in addition to destination country regulations.
8. Service Limitations
Please note the following service limitations:
- We operate Monday to Friday only (no weekend collections or deliveries).
- Weather conditions, natural disasters, and unforeseen events may affect delivery schedules.
- Customs delays are beyond our control and may extend delivery times.
- Remote locations may incur additional delivery charges.
- Service availability may vary during public holidays in both origin and destination countries.

We shall not be held liable for parcels diverted by customers to their safe places such as pick-up
lockers, or shop, shed or outbuilding, bin, garage, neighbours, front porch etc.
- We shall not be liable for damages to parcels containing liquid content.
- We shall not be liable for parcels submitted through our Agents whose cartons or packaging become damaged in transit.
- We shall not be liable for missing items or damage caused to items as a result of the customer missing the delivery by our courier partner.
- We shall not be liable for damage caused to items or missing items as a result of shipment abandonment in our warehouse for more than 7 days.
- We shall not be liable for any loss or damage caused to parcels abandoned in our office by the customer due to incomplete or non-payment of bills or any other circumstances.

11. Limitation of Liability
THE ELITE CREATIVE SOLUTIONS SHALL NOT BE LIABLE FOR:
- Delays caused by customs clearance, weather, or carrier issues beyond our control.
- Any consequential, indirect, or punitive damages.
- Loss or damage to items without proper purchase invoice documentation.
- Items that are improperly declared by customers.
- Duties, taxes, or customs fees imposed by destination countries.
- Goods seized by customs due to the nature of the items or failure to comply with destination country regulations.

Goods seized by customs in destination countries when customers ship items not allowed in those countries.
- Parcels lost or damaged due to consignee's failure to pay CUSTOMS DUTY & VAT on time.
- Parcels diverted to safe places as per customer's arrangement (e.g., pick-up lockers).
- Missing items or damage caused to items as a result of the customer missing the delivery by our courier partner.
- Damage caused to items or missing items as a result of shipment abandonment in our warehouse for more than 7 days.
- Any loss or damage caused to parcels abandoned in our office by the customer due to incomplete or non-payment of bills or any other circumstances.

Any issues arising from customer's failure to provide required statement of origin certificates or other customs documentation.
Our maximum liability for damage/lost claims is limited to ₦100,000 (one hundred thousand Naira) + freight cost, and only applies when proper purchase
invoice documentation is provided. Parcels with a declared value below ₦70,000 are duty & VAT free and exempt from the invoice requirement.
12. Termination of Services
We reserve the right to terminate or suspend services for:
- Violation of these terms and conditions.
- Failure to provide required documentation.
- Shipping of prohibited or restricted items.
- Non-payment of fees or charges.
- Fraudulent or misleading declarations.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. The Parties shall make reasonable efforts to resolve any dispute, claim, or controversy arising out of or relating to this Agreement through amicable negotiations. Where such negotiations fail to resolve the dispute, the matter may be referred to arbitration in Lagos, Nigeria, or any other location within Nigeria as may be agreed by the Parties or determined in accordance with applicable Nigerian law.
